Warranty policy
This Limited Warranty (the “Warranty”) applies exclusively to the [*] product line sold by SIOS Ingeniería, S.A. de C.V. (“SIOS”) and duly purchased by the Customer.
1. Coverage
1.1
In accordance with the terms and conditions contained herein, SIOS guarantees, during the Warranty Period (as defined below), that this product and its components are free from defects in materials and workmanship. SIOS will, at its sole discretion, repair or replace the defective part, as appropriate, as well as any defective parts or components at no charge to the Customer. This Warranty only covers the product and serial number indicated in this document.
2. Warranty Period
2.1
This Warranty is valid for six (6) months from the date of the sales invoice (the “Warranty Period”).
2.2
If the Warranty Period has expired, the Customer must pay for any repairs. In such case, the Customer may bring the equipment to our offices located at Manolo Martínez No. 144, Colonia Del Prado, Monterrey, N.L., Mexico, C.P. 64410 (“SIOS Offices”) for an estimate. Office hours: Monday to Friday, 8:00 a.m. to 6:00 p.m.
3. Conditions
3.1
This Warranty is valid only when the Customer presents this Warranty document, the original invoice or proof of purchase clearly showing the purchase date and product model, along with the defective product during the Warranty Period at the SIOS Offices for diagnosis. Likewise, this Warranty is only valid if performed by authorized SIOS Technical Service personnel.
3.2
If the product is within the Warranty Period, SIOS agrees to repair and/or replace the defective element at no cost to the owner. SIOS reserves the right to use new or refurbished parts at its discretion and will retain possession of any removed parts from repaired products.
3.3
If, in SIOS’s judgment, product repair is not possible, it will be replaced with a new product of the same model or a similar one (if the original model is no longer available in the market).
3.4
Repair time will not exceed thirty (30) business days from the date the product is received by SIOS.
3.5
SIOS reserves the right to deny free warranty service if the required documents are not presented, or if the provided information is incomplete or illegible. This warranty will not apply if the product’s model name or serial number has been altered, erased, is missing, or illegible.
3.6
Customers outside the metropolitan area of Monterrey, N.L., may send their equipment along with a copy of the invoice, having previously requested a Return Merchandise Authorization (RMA) via email at clientes@sios.mx or phone at +52 (81) 8344-1881. Shipping and return costs will be borne by the Customer. SIOS is not responsible for any damage or loss suffered by the product during its transportation to or from SIOS offices.
3.7
To avoid unnecessary inconvenience, we advise you to read the instructions carefully or contact SIOS for additional support.
3.8
The repair work and remedies established in this Warranty do not extend or renew the original Warranty Period. The warranty period for replacement parts ends with the Warranty Period of the entire product.
3.9
For commercial components and parts such as frequency inverters, contactors, motor protectors, electronic boards such as PLCs, screens, CPUs, and other products not manufactured by SIOS, the warranty will be transferred from the original manufacturer to the Customer.
4. Warranty Exclusions
4.1
This Warranty is invalid and does not cover the following cases:
(a) When the product has been used under abnormal conditions.
(b) When the product has not been operated according to its user manual.
(c) When the product has been altered or repaired by unauthorized personnel.
(d) When the Warranty Period has expired.
(e) When the serial number is missing or unrecognizable.
(f) When the defect results from force majeure or unforeseen events, including but not limited to natural disasters, floods, lightning, earthquakes, war, vandalism, theft, blackouts, or unexpected voltage changes.
(g) When the product or its components are damaged due to impact, insufficient packaging, careless handling, or malicious treatment.
(h) Failures caused by electrical installations, including but not limited to short circuits, poor grounding, or power surges.
5. Warranty Limitations
5.1
THE WARRANTIES EXPRESSLY SET FORTH ABOVE CONSTITUTE THE ONLY WARRANTIES APPLICABLE TO THE PRODUCT.
5.2
SIOS, ITS SERVICE CENTER, OR ANY OF ITS AFFILIATES, EMPLOYEES, OFFICERS, DIRECTORS, OR AGENTS SHALL NOT BE LIABLE IN ANY WAY FOR DAMAGE OR INJURY TO PERSONS OR PROPERTY, OR FOR ANY LOSS OR DAMAGE ARISING FROM OR RELATED TO THE PRODUCT, INCLUDING, WITHOUT LIMITATION, ANY PRODUCT DEFECT OR THE USE OR INSTALLATION THEREOF.
5.3
SIOS, ITS SERVICE CENTER, OR ANY OF ITS AFFILIATES, EMPLOYEES, OFFICERS, DIRECTORS, OR AGENTS SHALL IN NO EVENT BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, LOSS OF USE, PROFITS, PRODUCTION, OR REVENUE FOR ANY REASON WHATSOEVER. ANY LIABILITY OF SIOS, IF APPLICABLE, SHALL NOT EXCEED THE INVOICED VALUE PAID BY THE CUSTOMER FOR THE SUPPLIED PRODUCT(S).
6. Customer Acceptance
6.1
By signing and/or receiving the invoice or any document certifying the purchase of the product, the Customer unconditionally accepts these warranty policies and conditions and waives any claim not covered by this document.
7. Governing Law and Jurisdiction
7.1
This document shall be interpreted in accordance with the state and local laws of the State of Nuevo León, Mexico.
7.2
The Customer and SIOS agree that any dispute, controversy, difference, or claim concerning the interpretation, execution, fulfillment, or nullity of this document shall be expressly submitted to the competent courts of Monterrey, N.L., Mexico, expressly waiving any other jurisdiction or venue that may correspond by reason of their present or future domicile.
